Nursing Home Abuse and Neglect

At Legal Advocates for Seniors and People with Disabilities (LASPD), we protect the rights of the elderly in situations where there is repeated abuse and neglect caused by nursing home employee misconduct.

Far too often, the administration and management of a nursing home is concerned about the dollars and cents of the business, rather than providing a safe and healthy environment.  This is supported by some of the statistics which suggest that nearly two million American nursing home residents, age 65 or older, have been abused or neglected in some fashion.  However, the law in many states affords those who have been harmed, neglected or abused legal remedies to not only change the unsafe environment but also to receive money damages.  The nursing home industry is heavily regulated by both federal and state law in order to protect those who cannot protect themselves.

Nursing Home claims resulting from employee misconduct or negligence include:

  • Decubitus ulcers/bed sores - proper supervision is required to prevent this
  • Medication errors - medication administration records are important
  • Malnutrition/dehydration - tube feeding mismanagement
  • Falls - each resident must be assessed as to whether they are a fall risk
  • Wandering outside the nursing home - a nursing home should have proper alarms
  • Physical or sexual abuse - a nursing home is strictly liable for its employees physical or sexual abuse of a resident
